1. Acceptance of Terms

By accessing or using EverPaw ("the Service," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We reserve the right to update these terms at any time without prior notice. Continued use of the Service after any changes constitutes your acceptance of the new terms.

2. Description of Service

EverPaw is a pet memorial platform that allows users to upload photos of their pets and generate interactive 3D models using AI. The Service includes a 3D sanctuary viewer, an AI-powered chat interface to interact with a digital representation of their pet, and related features. The Service is intended as a memorial and comfort tool and is not a substitute for professional grief counselling.

3. Eligibility

You must be at least 18 years of age to use the Service. By using EverPaw, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into these Terms. If you are under 18, you may not use the Service under any circumstances.

4. User Accounts

You must create an account to use EverPaw. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate information and to notify us immediately of any unauthorised use of your account by contacting us on X (Twitter) at @everpawlove.

5. Subscriptions and Payment

EverPaw offers a 30-day free trial followed by a paid subscription at $9.99 per month (or equivalent local currency). By providing payment details, you authorise us to charge your payment method on a recurring monthly basis. We reserve the right to change pricing or subscription terms at any time without prior notice. Any price changes will take effect at the start of your next billing cycle.

You may cancel your subscription at any time. Upon cancellation, you will retain access to the Service until the end of your current billing period.

6. No Refunds

All payments are final. We do not offer refunds on subscription payments already processed, except where required by applicable law. If you believe a charge was made in error, please contact us on X (Twitter) at @everpawlove and we will review your case at our sole discretion.

7. User Content

You retain ownership of all photos and content you upload to EverPaw. By uploading content, you grant EverPaw a non-exclusive, worldwide, royalty-free licence to use, process, and store your content solely for the purpose of providing the Service. You are responsible for ensuring you have the right to upload any content you submit.

8. Third-Party Services

EverPaw relies on third-party APIs and services to deliver its features, including Tripo3D (3D model generation), Anthropic Claude (AI chat), Supabase (data storage and authentication), and Stripe or Paddle (payment processing). Your use of these features is subject to the respective third-party terms of service and privacy policies. We are not responsible for the acts or omissions of any third-party service provider.

9. Service Availability

We do not guarantee that the Service will be available at all times or without interruption. EverPaw may be temporarily unavailable due to maintenance, upgrades, or circumstances beyond our control. We are not liable for any loss or inconvenience resulting from service interruptions.

10. Limitation of Liability

To the fullest extent permitted by applicable law, EverPaw and its owners, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service. This includes but is not limited to loss of data, loss of revenue, or emotional distress. Your sole remedy for dissatisfaction with the Service is to stop using it.

11. Account Termination

We reserve the right to suspend or terminate your account at any time, for any reason, including but not limited to violation of these Terms. Upon termination, your right to access the Service ceases immediately. We are not liable to you or any third party for any termination of your account.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable international law. Any disputes arising under these Terms shall be resolved through good faith negotiation. If a dispute cannot be resolved informally, both parties agree to submit to the jurisdiction of a mutually agreed upon neutral forum. EverPaw reserves the right to update the governing law provision at any time with notice posted on this page.
